GOP Party Officials Nick Egoroff & Doug Guetzloe File Suit Against The Republican Party of Florida Over Republican Party Purge

A lawsuit was filed this morning (9/24/09) by elected Orange County Republican party executive committee members Nick Egoroff and Doug Guetzloe to nullify the recent action by Republican Party of Florida Jim Greer to remove or suspend duly elected Republican party leaders who have disagreed with Greer and other party bosses.

The lawsuit (2009-CA-030146-O), filed in Orange/Osceola Circuit Court has been assigned to the Honorable Robert Evans and it seeks to re-seat both Egoroff and Guetzloe on the Orange County Republican Executive Committee, who were removed without due process by RPOF Chairman Jim Greer based on a bogus complaint by embattled Orange County REC Chairman Lew Oliver.

This lawsuit comes on the heels of a recent court victory in the Third District Court of Appeal that affirmed an injunction against RPOF to allow the seating of Dade County REC members that the party has attempted to expel.  That ruling lays a precedence for the removal of embattled Orange County REC Chairman Lew Oliver, who previously removed 17 duly elected REC members immediately before the Chairman’s election last December.  Oliver then conducted an election for Chairman and declared himself the winner by one vote.  Another Orange County court case seeking to invalidate Oliver’s election will be combined with this lawsuit.

Constitutional attorney Fred O’Neal is representing Egoroff and Guetzloe.

“This is a huge battle for the First Amendment, due process and the ability of Republicans to control their own party.  We will win this lawsuit and the battle for the heart and soul of the Republican Party will register a huge victory in Orange County,” stated Guetzloe.  “We will put a stop to the party purge.”

Guetzloe has been an elected member of the Orange County Republican Executive Committee for 29 years.  He was named “Outstanding Republican in Orange County” by the REC in 1989 for leading the voter registration drive that moved Orange County into the Republican column.

Both Guetzloe and Egoroff were elected by wide margins in their individual precincts in 2008, in spite of concerted negative campaigns orchestrated by Lew Oliver and Jim Greer.

Oliver has also been implicated in financial misdeeds by spending over $100,000 in party monies over the past year with no party approval, including over $55,000 to himself and a consultant.

The Federal Election Commission (Case #MUR6202) is investigating the alleged illegal transfers and payments to Oliver.

Powerful letter written to Lew Oliver, OCREC Chairman responsible for putting away 3 or more of Orange Counties Republican Party Leadership

Dear Mr. Oliver,

While I am not interested in any legal accusations that were brought against you, I will say that you have failed the local party and have NOT acted in the best interest of conservatism, but in self preservation.  I do not know you personally and I am not going to make personal attacks, but I am going to try and change things from the leadership down in this party.  The reason the republicans lost so much ground is simply because republicans, exactly like democrats, sold out the American people for the status quo, to keep their positions.  I do not think you are a good leader at this point in your leadership role, and I do think it is time for someone who understands the sins of the party and is willing to endorse and seek true conservatives to our local, state and national scene.  I think Mr. Greer is a disgrace to the state party and a yes man for itself promotion and preservation.  I will also tell you, I am NOT alone in my thinking.

I was in Washington DC for the 9/12 march and I spoke with hundreds of republicans who are disgusted with the party to the extent of leaving it for a third party. I spent much of my time begging them to get involved in their local executive committee’s and change the party from within, not abandon it.  You and many of the republican establishment just DO NOT get it.  You have left us, you have abandoned our principles, you have put money behind unelectable RINO republicans who sold us out time and time again.  This opposition you speak of in your email is against both parties, we are sick of everyone who has gone along year after year with this nonsense to the point we are now fighting for the very existence of our Republic as it was divinely inspired to our founders.

Enough is enough. I was not a Ron Paul supporter, I spent hours laboring for McCain and only because of Palin….he was a horrible choice but nonetheless, the choice of the “republican establishment” who are so blind to the obvious ways our national media uses your ignorance.  If I had to do over again, I would have supported Ron Paul since he is the only one that has honor and pushes forward on the premise that our founder and our Constitution were right on target.

I will be at the meeting, I will be challenging my precinct’s committee woman who has been in place for way too long.  This is OUR party and we are not taking any crap, not anymore.  If we are all kicked out, have fun with what is left because this movement is too large and too strong, we will have a third party that will annihilate the republican party.  Our children’s future depends on it.

In closing, your whining and “pick on me” emails and press releases are truly nauseating and another reason you should be voted out of your position.  You left yourself open to these accusations and that is your mistake. You sound like a liberal forever crying over so called “attacks” that never amount to anything because everyone who investigated has been on YOUR side. I for one don’t care, I just want you replaced with a leader that can get things done for our county and our state. You record speaks for itself, no jury necessary.

Egregious Violators according to the Examiner

Yesterday, the Florida Republican Party took steps against two egregious violators of Party rules. Orange County Executive Committee members Douglas Guetzloe and Nicholas Egoroff were suspended from their posts after the State Party’s Grievance Committee upheld complaints against them. Essentially, the complaints included allegations that Mr. Guetzloe and Mr. Egoroff had violated their Party loyalty oaths, as well as Florida statutes by supporting non-Republican candidates who ran against Republicans in previous elections. State Party Chairman Jim Greer’s authority to discipline party officers is contained in Title X of the Florida Statutes. The pertinent section states:

“103.161 Removal or suspension of officers or members of state executive committee or county executive committee.—
(1) The chair of the state executive committee is empowered to remove or suspend from an office within the chair’s political party any . . . precinct committeeman . . . for a violation of the oath of office taken by such individual or for engaging in other activities described in this section.
(2) Such violation may include engaging in activities that have or could have injured the name or status of the political party or interfered with the activities of the political party. The chair has sole discretion to determine if a violation occurred.
(3) Upon the chair’s determination that a violation of the oath of office occurred or that an individual engaged in other activities described in this section, the chair may remove or suspend the individual from his or her office. . . . If the chair suspends the individual, the chair shall determine the length of the suspension.”

Mr. Guetzloe was suspended for sixteen months and placed on probation for an additional two years, while Mr. Egoroff was removed for a period of four years. Both former Executive committee members have been dogged by controversy over their commitment to the Party, as required by their oaths of office. Mr. Guetzloe had been removed from the Committee once before for supporting the campaigns of Democrats running against Republicans in local contests, including Orlando Mayor Buddy Dyer and Orlando City Commissioner Patty Sheehan. Mr. Egoroff, who had supported Ron Paul’s presidential bid, was charged with campaigning against Republican nominee John McCain after Paul’s defeat in the primaries. Guetzloe and Egoroff had also been part of an attempt by defeated Orange Republican Chairman candidate Deon Long to hold a rogue ‘re-do’ election at an illegally held meeting.

When asked for comment, Orange County Executive Committee Chairman Lewis Oliver stated he was pleased with the State Party’s decision to sanction Guetzloe and Egoroff, who had been extremely disruptive of Committee activities. He expressed the view that, without them, the local party will be better able to carry out its mission.

Florida’s Republicans have formed a circular firing squad and are cold poppin’ caps in each others’ asses. It’s all quite entertaining, really. And it’s happening locally and statewide. Fun for everyone!

Remember a while back when we told you about Orange County Republican Executive Committee chairman Lew Oliver’s catfight with Deon Long, the Winter Park lawyer who came one disputed vote from dethroning Oliver last December [“Coup d’état,” April 9]? This wildly popular column also told you when Oliver had Long tossed from the GOP – the optics of which aren’t great, considering that Long is one of the state Republicans’ precious few black faces. The bloodletting continues: As 580-AM WDBO reported last week, Oliver has now moved to oust loudmouthed critics Doug Guetzloe and Nick Egoroff. Oliver told WDBO that the two had violated party rules with a robocall touting Long.

This isn’t the first time Oliver has gone after Guetzloe [see “The loyalty oath,” April 10, 2003]. But it’s hardly shocking that the anti-Oliver forces declined to roll over. On July 28, WFTV Channel 9 reported that OCREC member Keith Racine had filed a complaint with the Florida Department of Law Enforcement accusing Oliver of money-laundering and using campaign funds for his own pleasure. Oliver denied the charges, but it’s hardly the kind of thing a guy barely clinging to power needs these days.

Oliver’s ally, state GOP chairman Jim Greer, isn’t winning any popularity contests either, particularly among conservatives (although, in fairness, he was just tapped to head the Republican National Committee’s rules committee). “Greer is the single most disliked guy on the RNC,” South Carolina GOP leader Katon Dawson told Republican house organ the Washington Times. And more recently, Brevard County party chairman Jason Steele accused Greer of attempting to “purge” the party of nonconformists and conducting a “witch hunt” of loyal conservatives. According to the St. Petersburg Times’ The Buzz blog, Steele himself faces grievance charges, purportedly after announcing he wouldn’t be endorsing candidates backed by the party machine (cough Charlie Crist cough).

Infighting within the Republican Party is now garnering statewide press, thanks to two election-related fraud complaints filed by Orange County Republican Executive Committee member Kevin Recine.  Recine’s complaints allege that Orange County Republican Chairman Lew Oliver committed “fraud” by not properly accounting for expenses and by setting up a secret fundraising account without approval from the Executive Committee.

The St. Pete Times is reporting that GOP State Party Chairman Jim Greer is at the center of the controversy, particularly his efforts to purge the Republican Party of the individuals who have become known as “Ron Paulites.”  Greer is being criticized by activists within the party for quietly instituting a change in the party’s loyalty oath that disqualified numerous Executive Committee members around the state.  According to the Times, after changing the loyalty oaths guidelines, Greer went public with his support of Charlie Crist in the GOP Senate primary, further angering Marco Rubio supporters within the party.

The controversy is not limited to central Florida.  Brevard County REC Chair Jason Steele is facing party sanctions for asking the party to remain neutral in GOP primaries.  In St. Johns County, builder Will Pitts, the Chairman of the Florida Republican Liberty Caucus, will face a hearing called by state party chair Jim Greer on July 25 that could ban him from holding any future leadership positions within the party.

Much of the infighting is related to ongoing resentment between the long-standing coalition of business and social conservatives within the party and libertarians who were drawn to the party in support of the 2008 Presidential campaign of Rep. Ron Paul.  In many counties, Duval and St. Johns included, libertarians (or “Ron Paulites”) attempted to gain control of the local party’s executive committee by flooding the committee with libertarians who would then work to elect like-minded individuals to leadership positions.  The state party has been rather successful up to this point in preventing that scenario from playing out.  And, based on the new rule changes from Jim Greer, the party has no intentions of leaving future takeovers to chance.

Despite the unfavorable press, party infighting is not always a bad thing.  After all, the Democratic Party of 2002 was a rather demoralized, dispirited bunch.  They seem to have recovered rather nicely by 2006.

Questions arise over Florida GOP spending

The Republican Party of Florida is facing a call for an audit after logging expenses for such items as trips to Disney World. Party bosses defended the expenses.

TALLAHASSEE — Republican Party of Florida chairman Jim Greer is being asked to answer to a call for an audit of party books amid questions from top Republican leaders as well as rank and file members about spending on chartered jets, five-star hotels, sports tickets and even men’s clothing shops this election cycle.

”There are many folks who believe it’s time for the RPOF to run the party with an eye toward fiscal discipline,” said Brian Ballard, Florida finance chairman for the John McCain campaign. “Not a day goes by where somebody won’t grab me and say you have to get control of the party — it’s out of control.”

While concerns about Greer’s spending have been festering behind the scenes for weeks, New Port Richey Republican Joe Aloisio brought the dust-up into the open Thursday when he sent a letter to party members calling for an audit of party finances.

He asked why the party bought tickets to sporting events such as Tampa Bay Rays and New York Yankees games, trips to Disney World, and spent $682,000 on chartered planes when it could have been spending on TV and radio advertising for John McCain.

”Misappropriated money from the RPOF would have easily financed Spanish language and African-American media . . . and picked up the 3 percent we needed to win for John McCain,” he wrote.

LEADERS RESPOND

Greer and party budget committee chairman Allan Cox responded to Miami Herald questions about the issue Saturday. They both defended the expenses, saying they primarily reflect gifts, tickets, transportation and high-end venues for fundraisers held by the party on behalf of McCain but also by House and Senate Republican leaders to attract large contributions from major donors.

”If you’re going to ask someone to contribute $50,000 to $100,000, you want an event the donor would be receptive to attending,” Greer said. The party has not only raised a record $23 million this year, he said, its major donor program “has broken every fundraising goal.”

In a detailed letter to state executive committee members Saturday, Cox said the accounting system was accurate and sound and “organized to function at corporate-level standards.”

After The Herald first broke this story online, Gov. Charlie Crist made it clear he doesn’t need another audit to put his support behind Greer. In a letter to Republicans late Saturday, he endorsed Greer for another two-year term as party chairman and commended him for “decisive leadership, energy, a tireless commitment to building our Party and promoting the Republican Party’s principles and values.”

Cox, the party’s budget chairman for the past six years, wrote that claims of misspending are based on political innuendo to suggest fiscal abuse.

Aloisio, 41, said he was alerted to the issue after reading a blog by Republican political operative Roger Stone in October calling for a ”forensic audit” of party books.

”This guy needs to be audited,” he told The Miami Herald. “It’s crazy how much money is being spent when people are scared for their futures and walking away from their homes. This is what McCain stood for.”

Stone, who says he doesn’t know Greer, said he was frustrated that the McCain campaign was financially strapped in Florida and the party should have recognized “that the McCain campaign, by choosing to take public finance, was limited.”

Greer responds that all the money raised in Florida was sent to the McCain campaign in Virginia and returned based on spending decisions the campaign made according to a “Victory Plan.”

”Decisions about how money was to be spent were made by others,” he said. “I also was not going to allow the RPOF to go into debt for the presidential candidate — which has happened previously.”

The financial concerns have prompted some in the party to start recruiting challengers to Greer when he is up for reelection in January.

There is no other way to write this story than in the first person and as it happened. That is because the Republican Party of Florida wanted no written or videotaped record of the proceedings I am about to relay.

One July 13, 2009 Fedex delivered to me a document simple in nature yet chilling in effect. Ten days from that date I was to appear before the RPOF ‘Grievance Committee’ for certain offenses that in all likelihood would lead to my expulsion from the party.

In a long one paragraph statement my County Chairman, Mr. Lew Oliver, described certain offenses which he deemed bad enough to warrant removing me from the party I had been a member of since I had turned 18 (I am now north of 50;-). Technical note: I could still call myself a Republican, I just could not be part of the executive committee which steers the direction of the party; something I had been a part of for the last 2 years.

The first thing that struck me about this announcement was the sloppy nature in which it was written. Constant grammatical and spelling errors occurred throughout the citation. Mr. Oliver, despite holding the highest office of the party at the county level, had yet to either learn proper English or use a word processor.

In the very first sentence he states: “Mr. Egoroff (1) engaged in ‘dirty tricks’ in the fall election by cooperating to send out a primary endorsement mailer under the fake name ‘republican victory committee’ EVEN THOUGH MR. EGOROFF HAD PREVIOUSLY BEEN SPECIFICALLY WARNED BY RPOF COUNSEL NOT TO USE THE REPUBLICAN NAME WITHOUR PERMISSION.’ Note the lack of capitalization in Republican Victory Committee and the typo in ‘withour’. Mind you, this is an official notice from Mr. Oliver.

Without going into too much detail, I refute this by saying I was never warned by RPOF about this mailer. Secondly, both the Florida Division of Elections and the Orange County Supervisor of Elections were both contacted and said there would be no problem using that name. Thirdly, I am new to the technicalities of using the word Republican which is violated every day with no repercussions.

I had ten days to prepare for this important meeting. Fortunately, they named Doug Guetzloe, as my co-conspirator. Mr. Guetzloe has over 30 years of experience in fighting tax increases through his group Ax The Tax. He has also held many positions in the Orange County Republican Executive Committee (the official name of the organization we were both about to be booted from).

He recommended retaining legal counsel through attorney at law Fred O’Neil. Mr. O’Neil had represented Doug for many years and had even argued cases before the Florida Supreme Court. We began a fundraising appeal and Mr. O’Neil was retained.

We knew this was an uphill battle. The Grievance Committee was made up of State Chairman Jim Greer appointees. These people knew that Mr. Greer had dealt ruthlessly with opponents in the past, and undoubtedly knew what the desired outcome was. So much for having an unbiased jury!

On the day of the hearing Mr. O’Neil had suggested that we hire a court reporter to transcribe the event. We knew that if we wanted to appeal the likely negative outcome of this hearing we would want evidence of what happened that day. The RPOF lawyer said no go. This was a private hearing. No taping or transcribing.

This was a clever move on their part to cover their tracks lest one of the inquisitors, er, committee members display their bias or make any other mistake that would come back to haunt them.

Both Doug and myself had a couple of meetings with Mr. O’Neil but we can’t divulge much of the strategy because we are assuming that further legal proceedings will occur. Suffice it to say that RPOF has always maintained that it is a ‘private club’ and can do what it wants. Our premise is that America is essentially a two-party system and that both of these parties are recognized as statutory entities by the state of Florida. Their bylaws are even part of Florida Statutory Law—something that is not accorded to any other political party (check it out on the Florida Statutory Code 103).

I could go on about the juvenile behavior of one committee member who repeatedly badgered me with questions like, ‘Does Doug Guetzloe think for you? Does Doug Guetzloe tell you what to say? Does Doug Guetzloe order you around?’ Which were all questions machinegun fired at me. Each time I tried to answer the woman would shriek, “Just answer the question Mr. Egoroff!” This may be the way you talk to a child, but it is not a professional way to address a man who has successfully run his own business for 20 years.

I’ll just close with the following statement. The Republican Party of Florida needs to stop slamming the doors on people that have new ideas. The Republican Party of Florida needs to stop looking at membership like it’s joining an exclusive country club. In short, the Republican Party of Florida had better stop threatening and smearing new members or it will find itself the defendant in a civil liberties lawsuit that will shake it to the core.

P.S. I should add that this is part of a statewide purge with 10 people likely to be expelled in this round, and dozens of more ‘grievances’ sitting on Chairman Jim Greer’s desk.
